How to check whether a trademark is free
An online search in the public register is a good first step: it shows exact matches straight away. But the outcome is usually decided by something else — similarity to the point of confusion, pending applications, adjacent classes. Does the absence of an exact copy mean the mark can be registered?
No.
The very same word can be harmless in one class and fatal in the class next door. The register will show you these lines — it will not tell you which one is yours. A real opinion also weighs the priority date, the status of each mark and the list of goods inside the class. The example is given by way of illustration.
If you are planning to register
The register tells you whether an exact match exists. It does not tell you whether your mark will be registered — that turns on similarity, on NICE classes, and on other people’s applications still under examination. What you need at that point is an opinion, not a search.

Why a trademark check is worth doing with a patent attorney
