How to check whether a trademark is free

An online search in the public register is a good first step: it shows exact matches straight away. But the outcome is usually decided by something else — similarity to the point of confusion, pending applications, adjacent classes. Those are the finer points we suggest looking at before you file — and we will help you read them.

The trap of a plain search: why the register looks clean

Does the absence of an exact copy mean the mark can be registered?

No.

The very same word can be harmless in one class and fatal in the class next door. The register will show you these lines — it will not tell you which one is yours. A real opinion also weighs the priority date, the status of each mark and the list of goods inside the class. The example is given by way of illustration.

The register tells you whether an exact match exists. It does not tell you whether your mark will be registered — that turns on similarity, on NICE classes, and on other people’s applications still under examination. What you need at that point is an opinion, not a search.

Why check a trademark before you file

A trademark search — also called a patent search or a name clearance — shows whether your sign is free: whether a similar mark already exists, which NICE classes it covers, and whether someone filed before you did.

Examination in Ukraine takes 14–18 months. A conflict that surfaces at that stage costs both the official fees and a year of time — while the brand has meanwhile acquired advertising, packaging and signage.

A refusal does not require an identical match: similarity to the point of confusion is enough, where a consumer could mistake one sign for the other. So checking a trademark means weighing the risk against similar marks in your class and the neighbouring ones, not typing the name into a register search.

Why a trademark check is worth doing with a patent attorney

Wellmarks has worked in intellectual property since 2010: more than 5,100 registered trademarks and registrations in over 120 countries. Over those years we have seen both outcomes — the one where the clearance check was run in time, and the one where it was the thing the client decided to save on.

When the sign is checked before the application is filed, an arguable situation almost always leaves room to manoeuvre: narrow the list of goods, change or add a NICE class, rework the sign so that the similarity to the point of confusion disappears. When the application is filed blind, the same conflict resurfaces a year later — this time as a provisional refusal from UKRNOIVI, with the official fees spent and the name already on the packaging, the signage and the advertising. The difference between those two outcomes is usually one check starting at UAH 2,500.

We also take on the hard cases: descriptive names, signs on the borderline of similarity, conflicts with international registrations and with pending applications, disputes with owners of earlier marks.
