Trademark registration is of enormous importance for a business, because it provides legal protection and exclusivity in the use of identifying signs. Through registration, companies protect their brands, distinguish their products and services from competitors, maintain and strengthen their market position, and build trust and loyalty among consumers.

The illustrative examples are in front of everyone. Nike, Apple, Coca-Cola, Google, Amazon — all of these companies registered their signs at some point, and registration became the legal foundation on which the value of their brands is built. Without a certificate, a brand remains merely a name that, legally speaking, someone else can take.

What a trademark certificate actually gives you

Trademark registration provides the owner with several key advantages:

  • Protection against infringement. You gain a legal basis to demand that unauthorised use of your sign be stopped — from marketplaces and customs authorities through to the courts.
  • Exclusivity. The exclusive right to use the sign in the relevant classes of goods and services belongs to you alone.
  • Consumer trust. A registered mark becomes a symbol of quality and reliability rather than an arbitrary name on packaging.
  • Creating an asset. A trademark is an intangible asset that can be valued, placed on the balance sheet, sold, transferred under a licence agreement, or contributed to share capital.
  • Market position. A registered sign separates your goods from those of competitors and secures for you the recognition you paid for through advertising.

The practical side deserves a separate mention: without a certificate you cannot enrol your brand in the Amazon Brand Registry, record it in the customs register of intellectual property objects, or block counterfeits on online platforms.

Preparation before filing

Before filing an application with the relevant state authority, two steps are necessary.

First, determine the classes of use under the Nice Classification. The International Classification of Goods and Services divides everything into 45 classes. Legal protection operates only within the classes you specify in the application, so the list must be built around not only your current activity but also your plans for the coming years.

Second, conduct a search of trademarks already registered or filed for registration that are close to yours. Similar signs can cause a refusal of registration or create a potential threat to the use of your mark in the future. This is the cheapest way to learn about a problem before you pay the fees and spend a year waiting.

The stages an application goes through at UKRNOIVI

Once the preparation is done, you move on to filing the documents.

  1. Filing the application. Both natural persons and legal entities may register a trademark. The application must contain an image of the sign (in electronic and printed form), information about the applicant (full name and address for an individual, or company name, legal address, and EDRPOU code for a legal entity), and the list of goods and services for which the mark is being registered. A properly executed power of attorney is filed in addition. UKRNOIVI records the filing date and confirms payment of the fee — on average this stage takes around 2–3 weeks.

  2. Formal examination. Approximately 12 months after filing, UKRNOIVI announces the decision of the formal examination. It confirms — or does not confirm — that all data in the application has been completed correctly.

  3. Substantive examination. Eighteen months from the date the application was submitted, the office reports the conclusions of the substantive examination. These state the extent to which the applied-for trademark meets the conditions for legal protection and whether such a sign has been registered previously.

  4. Issue of the certificate. Two to four weeks after a positive conclusion and payment of all required duties, UKRNOIVI issues the trademark registration certificate for Ukraine. It is valid for 10 years and can then be renewed an unlimited number of times.

Priority date — the main reason not to delay

Although the whole procedure takes around two years, rights are counted from the filing date, not from the date the certificate is issued. This means a competitor who files one day later with an identical sign will be refused — even if they actually started using the name before you did. That is why filing should be planned before the marketing push begins, not after the brand has become visible.

What the final figure depends on

The final amount consists of official fees, which depend on the number of Nice classes and the type of sign, plus the cost of the patent attorney's services. The more classes, the higher the fee, so the list of goods and services should be justified rather than compiled "just in case".
